Living Trusts
A trust is an estate planning tool that allows you to designate beneficiaries to your estate’s assets as well as keep your estate out of probate. Beneficiaries are protected by having your assets pass outside of probate to your loved ones. A “living trust” or “inter vivos trust” is one that someone creates while he or she is still alive. This is distinguished from a trust that is made in accordance with your will after you die. A revocable living trust allows you to be the trustee during your lifetime and also allows you to cancel the trust prior to your death, should you desire to cancel the trust.
A living trust can also help to pass assets outside of probate. For example, often clients wishing to disinherit one child may use a living trust to pass assets such as houses and cars to the beneficiaries. Other clients are seeking privacy concerns.
There are many different types of trusts and we can assist in finding the right trust for your estate goals. We also help to make sure you understand the steps in changing title of your assets to the living trust so that the trust is funded and used. We unfortunately have witnessed many clients that have gone to firms, spending a lot of money on a living trust, and then never fund it because they thought their lawyer took care of it.
